Terms of service

These terms govern your use of the FieldDrive website and software. By creating an account or paying for a subscription, you agree to them. If you’re signing up on behalf of a company, you’re confirming you have authority to bind that company. Questions before you agree? Email support@fielddrive.app.
What we provide
FieldDrive LLC provides punch list and walkthrough software — FieldDrive Punch, FieldDrive Walk, and Agent Punch — delivered as a hosted service. We may add, change, or remove features as the product develops. If we remove something you rely on, we’ll give you notice by email before it happens.
Your account
- You’re responsible for keeping your login credentials secure and for activity that happens under your account.
- Your subscription tier sets how many users your company can have. Adding users beyond your tier requires moving to the next tier.
- You must be at least 18 and use FieldDrive for business purposes.
- Tell us promptly at support@fielddrive.app if you believe your account has been accessed without permission.
Payment, renewal, and cancellation
- Billing. Subscriptions are billed in advance through Stripe, monthly or annually depending on the plan you choose. Prices are in US dollars unless stated otherwise.
- Renewal. Plans renew automatically at the end of each billing period at the then-current price for your tier. We’ll email you before any price change affecting your renewal.
- Cancellation. You can cancel at any time. Your access continues to the end of the period you’ve already paid for, and we don’t charge a cancellation fee.
- Refunds. We don’t provide partial refunds for unused time. If something has gone genuinely wrong, email us — we’d rather sort it out than argue about it.
- Non-payment. If a payment fails and isn’t resolved, we may suspend access until it is.
Your data
Punch list items, photos, notes, project names, and everything else you and your team put into FieldDrive belong to you. You grant us only the permission needed to host, back up, and display that content in order to provide the service. We handle it as described in our privacy policy.
You’re responsible for having the right to upload what you upload, including photos taken on sites you have permission to document.
Acceptable use
- Don’t use FieldDrive to break the law, infringe someone’s rights, or store unlawful content.
- Don’t attempt to breach, probe, or overload our systems, or access another company’s data.
- Don’t resell, sublicense, or white-label FieldDrive without a written agreement with us.
- Don’t share a single user seat among multiple people to avoid moving up a tier.
Shared links to subcontractors
FieldDrive lets you send a link that gives a subcontractor or crew access to the items assigned to them, without an account. Anyone holding that link can see and update those items. You decide who receives it, and you’re responsible for that choice. You can revoke a link from inside the product.
Availability
We work to keep FieldDrive available and to preserve your data, including offline capture that syncs when your device is back in range. We don’t promise uninterrupted service — hosting providers have outages and we occasionally take the system down for maintenance. We’ll give notice of planned downtime when we can.
Termination
You can stop using FieldDrive and cancel at any time. We may suspend or end an account that breaks these terms, doesn’t pay, or puts other customers or our systems at risk. If we terminate your account without cause, we’ll refund the unused portion of what you’ve prepaid. After termination you can request an export of your data for 30 days, after which we may delete it.
Disclaimers
FieldDrive is a record-keeping tool, not a substitute for professional inspection, code compliance, or legal advice. Except as expressly stated here, the service is provided "as is" without warranties of any kind, to the fullest extent the law allows.
Limitation of liability
To the fullest extent permitted by law, FieldDrive isn’t liable for indirect, incidental, or consequential damages, or for lost profits, lost data, or project delays. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.
Changes to these terms
If we make a material change, we’ll update the date above and notify account holders by email at least 14 days before it takes effect. Continuing to use FieldDrive after that means you accept the revised terms.
Governing law
These terms are governed by the laws of the state in which FieldDrive LLC is registered, without regard to conflict-of-law rules. Before starting formal proceedings, both sides agree to try to resolve the dispute by email or a call.
